These Terms & Conditions ("Terms") govern your access to and use of RTKgpt, an AI-powered service operated by Freshminers B.V., trading under the name RTKsub ("RTKgpt", "RTKsub", "we", "our", or "us").

By accessing or using RTKgpt, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.

1. About RTKgpt

RTKgpt is an artificial intelligence assistant designed to help users with questions related to RTK positioning, GNSS technology, NTRIP, surveying, agriculture, construction, mapping, and related topics.

The Service is intended to provide informational assistance only and should not be relied upon as a substitute for professional judgment or technical expertise.

RTKgpt is currently provided free of charge. We reserve the right to modify, limit, introduce paid features, or discontinue the Service at any time.

2. Eligibility

By using RTKgpt, you confirm that:

  • You are at least 16 years of age, or you have permission from a parent or legal guardian where required by applicable law.
  • You have the legal capacity to enter into these Terms.
  • You will use the Service in compliance with all applicable laws and regulations.

3. Acceptable Use

You agree to use RTKgpt responsibly and only for lawful purposes.

You may not:

  • Use the Service for any illegal or fraudulent activity.
  • Attempt to gain unauthorized access to our systems or infrastructure.
  • Disrupt, interfere with, or impair the operation of RTKgpt.
  • Attempt to reverse engineer, copy, reproduce, or extract the underlying models, prompts, datasets, or source code.
  • Use automated scripts, bots, crawlers, or scraping tools to access the Service without our written permission.
  • Upload or submit malicious software, viruses, or harmful code.
  • Use RTKgpt in a manner that infringes the rights of others.
  • Attempt to circumvent security measures, rate limits, or usage restrictions.
  • Use the Service to generate unlawful, defamatory, abusive, hateful, or fraudulent content.

We reserve the right to investigate suspected misuse and to suspend or permanently restrict access where necessary to protect our users, systems, or legal interests.

4. AI-Generated Content

RTKgpt generates responses using artificial intelligence.

Although we strive to provide useful and accurate information, AI-generated responses may contain inaccuracies, omissions, outdated information, or incorrect interpretations.

You acknowledge that:

  • Responses are generated automatically.
  • Information may not always be accurate or complete.
  • Responses should always be independently verified before being relied upon.
  • You remain solely responsible for decisions or actions taken based on AI-generated content.

5. No Professional Advice

RTKgpt is provided for general informational purposes only.

The Service does not constitute professional surveying advice, engineering advice, legal advice, financial advice, safety advice, or any other form of regulated professional service.

Users should always consult an appropriately qualified professional before making decisions that could have technical, financial, operational, or legal consequences.

6. Availability of the Service

We aim to keep RTKgpt available and functioning reliably. However, we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We may temporarily suspend access for maintenance, updates, security improvements, or technical issues without prior notice.

We reserve the right to modify, replace, suspend, or discontinue any part of RTKgpt at any time.

7. Intellectual Property

Unless otherwise stated, all intellectual property rights relating to RTKgpt, including its software, website design, branding, graphics, logos, documentation, and original content, remain the exclusive property of Freshminers B.V. or its licensors.

These Terms do not grant you ownership of any intellectual property rights relating to the Service.

You may use RTKgpt solely for your own lawful purposes in accordance with these Terms.

You may not copy, distribute, modify, commercially exploit, or create derivative works from any part of the Service without our prior written permission.

8. User Content

You retain ownership of any information, questions, prompts, or other content that you submit to RTKgpt ("User Content").

By submitting User Content, you grant Freshminers B.V. a limited, non-exclusive, worldwide, royalty-free license to process such content solely for the purpose of operating, maintaining, securing, and improving RTKgpt.

You are solely responsible for the content you submit and represent that you have all necessary rights to provide it.

You agree not to submit content that:

  • Violates applicable laws or regulations.
  • Infringes intellectual property or privacy rights.
  • Contains malicious software or harmful code.
  • Contains confidential information that you are not authorized to disclose.
  • Promotes illegal, abusive, discriminatory, or fraudulent activities.

9. Third-Party Services

RTKgpt relies on third-party technologies and infrastructure to operate efficiently.

These may include hosting providers, analytics providers, artificial intelligence providers, and other technical service providers.

We are not responsible for interruptions, outages, or failures caused by third-party services beyond our reasonable control.

Your use of third-party services may also be subject to the terms and privacy policies of those providers.

10. Privacy

Your privacy is important to us.

Our collection and processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

By using RTKgpt, you acknowledge that your personal information may be processed as described in our Privacy Policy.

11. Disclaimer of Warranties

RTKgpt is provided on an "as is" and "as available" basis.

To the fullest extent permitted by applicable law, Freshminers B.V. disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of:

  • Accuracy
  • Completeness
  • Reliability
  • Availability
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee that:

  • The Service will always be available.
  • The Service will be free from interruptions.
  • The Service will be free from bugs or errors.
  • AI-generated responses will always be accurate, complete, or up to date.

You use RTKgpt entirely at your own risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Freshminers B.V., its directors, employees, affiliates, contractors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to your use of RTKgpt.

This includes, without limitation:

  • Loss of data.
  • Loss of profits.
  • Business interruption.
  • Loss of business opportunities.
  • Technical failures.
  • Errors in AI-generated responses.
  • Decisions made based on information generated by RTKgpt.

Nothing in these Terms limits liability where such limitation is prohibited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Freshminers B.V., its directors, employees, affiliates, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of RTKgpt.
  • Your violation of these Terms.
  • Your violation of applicable laws.
  • Your infringement of the rights of any third party.

14. Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate access to RTKgpt at our sole discretion if we reasonably believe that:

  • These Terms have been violated.
  • The Service is being abused or misused.
  • Continued access could create security, legal, or operational risks.

We may also suspend or discontinue RTKgpt entirely without liability if necessary due to technical, commercial, legal, or operational reasons.

Termination of access does not affect any rights or obligations that arose before termination.

15. Changes to these Terms

We may update these Terms & Conditions from time to time to reflect changes to RTKgpt, applicable laws, or our business operations.

When material changes are made, we will update the "Last updated" date at the top of this page.

Your continued use of RTKgpt after updated Terms become effective constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and AI Disclaimer, constitute the entire agreement between you and Freshminers B.V. regarding your use of RTKgpt and supersede any prior agreements, understandings, or communications relating to the Service.

18. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Netherlands.

Any dispute arising out of or relating to these Terms or the use of RTKgpt shall be submitted to the competent court in the Netherlands, unless mandatory law requires otherwise.
